Terms and Conditions

1. Introductory Provisions

These Terms and Conditions govern the booking and provision of accommodation within the Apartmány Lučany project.

The accommodation provider is:

These Terms and Conditions form an integral part of the accommodation agreement concluded between the accommodation provider and the guest.

2. Accommodation

The accommodation provider offers short-term accommodation in apartments in Lučany nad Nisou, in particular at Villa Hugo, including Hugo Infra Apartment and Hugo Finnish Apartment.

The current selection of apartments, prices, and basic information about their facilities and amenities are available on the accommodation provider's website.

3. Booking and Conclusion of the Agreement

A booking request may be submitted through the booking form on the website, by e-mail, or by telephone.

Submitting a booking request does not automatically guarantee accommodation. The accommodation agreement is concluded only when the accommodation provider confirms the booking in writing, usually by e-mail, including the dates of stay, price, and any additional conditions.

A booking becomes binding only once the full price of the stay has been paid, within the deadline specified in the booking confirmation. If the full price is not paid within the specified period, the accommodation provider is entitled to cancel the booking and offer the dates to another guest.

4. Accommodation Price and Payment Terms

The price of the stay is determined by the current rates published on the website or by an individual price quotation confirmed by the accommodation provider.

During the gradual renovation of the exterior of the property and the garden, stays may be offered at a reduced introductory rate.

The guest agrees to pay the full price of the stay using the payment method and within the deadline stated in the booking confirmation. Unless agreed otherwise, payment is considered completed on the date when the full amount is credited to the accommodation provider's bank account.

5. Refundable Security Deposit

The accommodation provider is entitled to require a refundable security deposit of CZK 3,000 per stay, payable before arrival or upon arrival.

The security deposit serves as security against demonstrable damage to the apartment or its equipment, loss of equipment, violation of the no-smoking policy inside the apartment, or exceptional soiling requiring additional cleaning beyond the standard level.

If the apartment is returned in good condition at the end of the stay, the security deposit will be refunded to the guest in full, usually within 48 hours after check-out.

6. Cancellation Policy

The guest may cancel a booking in writing by e-mail. The cancellation is considered effective at the time it is received by the accommodation provider.

The following cancellation conditions apply:

  • if the booking is cancelled more than 30 days before arrival, no cancellation fee will be charged,
  • if the booking is cancelled 14 to 30 days before arrival, the cancellation fee is 50% of the total price of the stay,
  • if the booking is cancelled 13 days or less before arrival, the cancellation fee is 100% of the total price of the stay,
  • in the event of a no-show without prior cancellation, the cancellation fee is 100% of the total price of the stay.

7. Arrival, Departure and Handover of the Apartment

Check-in is available from 3:00 PM.

Check-out must be completed by 10:00 AM.

A later check-out may be arranged in advance with the accommodation provider, but no later than 12:00 PM.

Access to the apartments is provided via coded entry doors. Guests will receive arrival and access instructions before the start of their stay.

Upon departure, the guest is required to lock the apartment, switch off appliances, leave the apartment in a reasonably tidy condition, and report any damage or exceptional incidents.

8. Rights and Obligations of the Guest

The guest has the right to use the accommodation, common areas, and services associated with the stay to the extent agreed upon at the time of booking. The accommodation provider is required to hand over the accommodation in a condition suitable for proper use and to ensure that the guest may exercise their rights associated with the accommodation without undue disturbance. The guest is required to use the premises properly and may not make any significant alterations without the accommodation provider's consent.

In particular, the guest agrees to:

  • use the apartment properly and with due care,
  • observe quiet hours between 10:00 PM and 6:00 AM,
  • not allow more persons to stay in the apartment than agreed,
  • immediately report any defect, damage, or exceptional incident,
  • comply with the no-smoking policy inside the apartments unless otherwise expressly permitted by the accommodation provider.

By prior arrangement, accommodation for up to 3 persons per apartment may be possible.

9. Rights and Obligations of the Accommodation Provider

The accommodation provider is entitled to refuse accommodation or terminate a guest's stay if the guest seriously breaches their obligations, damages the property or equipment, repeatedly violates quiet hours, or seriously breaches generally accepted standards of conduct. Under the Czech Civil Code, an accommodation provider may terminate an accommodation agreement before the agreed end date if, despite a warning, the guest seriously breaches their obligations or generally accepted standards of conduct.

The accommodation provider is not liable for damage resulting from circumstances beyond its reasonable control, including interruptions to utility supplies, force majeure events, or restrictions caused by extraordinary circumstances.

10. Facilities and Services

The accommodation includes, in particular, a private bathroom with shower and toilet, a fully equipped kitchen, television, storage space, bed linen, towels, and a sauna according to the type of apartment.

Wi-Fi is provided to guests free of charge.

During the summer season, lockable storage space for bicycles may be available by prior arrangement, and during the winter season, storage space for skis may be provided.

11. Current Condition of the Property

The guest acknowledges that the interiors of the apartments are fully prepared for accommodation; however, the exterior of the house and the garden may still be undergoing gradual renovation during the guest's stay. The accommodation provider informs guests of this openly and in advance. This circumstance is reflected in the current pricing.

12. Pets, Smoking and Other Restrictions

Pets are permitted only by prior arrangement with the accommodation provider.

Smoking is prohibited inside the apartments. Violation of this rule may result in the security deposit being partially or fully withheld.

Parties, noisy events, and any activities that may disturb other guests or neighbours are not permitted.

13. Complaints

If, upon arrival, the guest discovers any defect, deficiency, or discrepancy compared with the confirmed booking, the guest is required to notify the accommodation provider without undue delay so that the issue can be remedied.

The accommodation provider will handle complaints within a reasonable period according to the nature of the matter and in accordance with applicable law.

14. Consumer Right of Withdrawal

Where the accommodation agreement is concluded for a specific date or period, the consumer does not have the right to withdraw from the agreement without giving a reason within the standard 14-day withdrawal period.

This also applies to accommodation bookings made online for a specific date or period of stay.

15. Personal Data Protection

Guests' personal data is processed for the purposes of handling bookings, performing the accommodation agreement, and complying with related legal obligations.

16. Final Provisions

These Terms and Conditions take effect on 1 May 2026.

The accommodation provider reserves the right to make reasonable amendments to these Terms and Conditions. For each specific booking, the version of the Terms and Conditions in force on the date the booking is confirmed shall apply.

Any legal relationships not expressly governed by these Terms and Conditions shall be governed by the laws of the Czech Republic, in particular the Czech Civil Code.
